Every article usually only once in stock. – All items subject to prior sale. No delivery obligation. Enlarged property rights reserved up to full payment – net cash free of charges, pre-invoice reserved – in ref. to German Civil Code for all deliveries. Place of performance is Padingbüttel. Legal venue for both sides, as far as legally applicable, is Langen near Bremerhaven and Uelzen, Lower Saxony, for hortatory proceedings resp. For suits here optionally Hamburg. German law applies; the United Nations Convention on Contracts for the International Sale of Goods (CISG) is not applicable. Differing from that the clause shall apply that out of EU, Norway, and Switzerland in all cases of transactions with commercial addresses and analogous ones all disputes arising in connection with the present offer shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules. Place of arbitration shall be Stade, Germany, and generally this offer shall be subject to German substantive law. – All prices in euro (EUR). Quotations in other currencies for information only, whereby currentness and correctness of the respective applied exchange rates are not guaranteed. – Exportations in view of duties always “f.o.b.” (free on board) or free up to the German border resp., postage at buyer’s expense free destination. – Deliveries inside the European Union are liable to the German sales tax unless the customer is in the possession of a VAT identification number of his country and informs of this together with the order. – Private orders within the EU with the right of revocation with the consequence of the obligation to return wares equivalent to the way-out by re-using the original packing or an equal one within 14 calendar days after receipt. The costs for the way back need not to be taken over if the value of the returned wares exceeds EUR 40. For the way out within Germany a flat rate for shipping of EUR 6 + individual insurance + 19% VAT incurs. On request an offset against paid return shipping will be granted. The individual tariffs for EU countries beyond Germany have to be inquired. – Descriptions made according to the present state of the object and done with best knowledge and intentions, but are no guaranteed qualities as defined by §§ 459 ff. German Civil Code. In case of fake or mistake in ascription the purchaser may cancel the purchase within four weeks since completion. In which case the proof of fake or mistake has to be demonstrated by himself. Nevertheless cancellation is impossible if the attribution to an artist is according to the opinion of experts at the time of the sale and/or the object is not in the same state as when delivered. A claim for depreciation is not given. Furthermore any liability for any reason by the seller is reduced to the case the seller can be proven to have acted intentionally or with gross negligence. In this case the liability is limited to the foreseeable damage. – All rights for quoted texts and illustrations reserved to the owners of the copyright according to the law. Any reproductions have to be allowed in writing. – In case any one of these conditions should be or become legally void it shall be replaced by that most according to the economic intention. All other remain effective. – In case of any dispute the German version of these terms & conditions shall be legally binding.
